Key Considerations and Explanations
TCPA "Prior Express Written Consent" (PEWC): The language for SMS consent is designed to meet the stringent PEWC requirements. It clearly states that marketing messages will be sent, an autodialer may be used, and consent is not a condition of purchase. The inclusion of opt-out instructions ("STOP") is also a critical requirement.
Future Offerings: The language for both SMS and email consent is crafted to include not just the "Granite Park offering" but also "any other offerings in the future" from us.
